TERMS AND CONDITIONS OF SALE

TITRIVIN REFERENCE MATERIAL FOR OENOLOGY LABORATORIES

The transmission of an order for TITRIVIN reference wines to the Chambre d'Agriculture de la Gironde (CA-33) implies acceptance of the present general conditions of sale, to which no derogation will be made without the written agreement of the President of the Chambre d'Agriculture de la Gironde.
1 - DESCRIPTIONS
The specifications contained in TITRIVIN documentation are given for information only and are not binding. Parameter values and their associated confidence and acceptance intervals are subject to change when manufacturing batches are changed. Only the values given on the certificates of analysis are to be taken into consideration when using TITRIVIN reference wines. Certificates of analysis can be downloaded from our website.
2 - USE
TITRIVIN reference wines are exclusively intended for use in oenology laboratories under the sole responsibility of the users. The customer is not authorized to refer to the Reference Material Producer's COFRAC accreditation on any of its media, whatever their nature, nor to use the accreditation mark.
3 - PRICES
Our prices are expressed in euros; they are net, exclusive of tax and without discount, based on the rates communicated to buyers; they are revised periodically. CA-33 reserves the right to modify its prices without prior notice if it considers that the economic and financial environment makes this necessary.
4 - PAYMENT TERMS
Invoicing is based on the rates in force at CA-33 at the time the order is placed. Payment is due on receipt of invoice. Any payment after the due date will result in the application of late payment penalties calculated on the basis of the rate of default interest in force (law of 31/12/1992) increased by the amount of the indemnity for collection costs in accordance with article 121-II of law n°2012-387 of March 22, 2012. This indemnity is set at €40 by decree n°2012-1115 of October 2, 2012. Any delay in payment will lead, after formal notice, to the application of the internal collection procedure.
5 - ORDERS
In the event of an error in the wording of the order, CA-33 declines responsibility. Any resulting costs of return for non-conformity will be borne by the purchaser.
6 - SHIPPING DEADLINES
Unless temporarily out of stock or in exceptional circumstances, goods will be delivered within a maximum of one week following receipt of the order.
7 - SHIPPING OF GOODS
Shipping costs are the responsibility of the buyer. Unless otherwise stipulated by the purchaser, goods are shipped by the fastest postal service. At the buyer's written request, other means of transport (e.g. express courier) may be used. Any additional costs will be invoiced extra. Without prejudice to the measures to be taken with regard to the carrier, complaints about apparent defects must be made in writing within 5 working days of the arrival of the goods at the place of delivery. This claim must mention the references appearing on the delivery note and the batch numbers of the products concerned. Failure to comply with these instructions will result in the goods being deemed to have been accepted by the buyer.
8 - TRANSFER OF RISKS
The transfer of risks on the goods takes place from the moment of delivery. Goods travel at the recipient's own risk, and it is the recipient's responsibility to: check the condition and quantity of the goods on receipt, if necessary opening the packages in the presence of the delivery person; in the event of damage or shortages, to make the usual reservations on the transport receipt, specifying the nature of the damage or shortages; notify the carrier of the damage or shortages by registered letter with acknowledgement of receipt within three days, in accordance with article 105 of the French Commercial Code.
9 - RETURN OF GOODS
No return of goods will be accepted without prior agreement. In this case, the items will be returned in their original packaging, carriage paid, to the address communicated to the buyer.
10 - CLAIMS
All claims must be sent to CA33. The procedure for handling complaints is available at reception or on request.
11 - WARRANTY
The TITRIVIN warranty applies exclusively in the event of defects arising from hidden faults. It is strictly limited to the free shipment of products to replace defective products. By express agreement, our warranty does not cover damage in transit or any damages, particularly for personnel costs, loss of earnings, commercial disturbance, etc. TITRIVIN's warranty only applies if the products are stored in conditions that comply with our prescriptions.
12 - FORCE MAJEURE
Fire, floods, heat waves, strikes, wars, supply shortages and any other accidents that prevent or reduce manufacturing and services are considered as force majeure and release CA-33 from the obligation to deliver.
13- PERSONAL DATA
The personal data collected by the Chambre d'agriculture de Gironde as part of the above-mentioned service is necessary for its completion. However, the same data will be used to update the regional Customer Relationship Management database of the Chambers of Agriculture of New Aquitaine, which is accessible to all their employees, and whose purpose is to be able to send you information likely to be of interest to you: regulatory and institutional news, agricultural disasters, services, training... 14 - CLAUSE ATTRIBUTING TO JURISDICTION
In the event of a dispute, before taking any legal action, the parties will seek an amicable settlement. If the dispute persists, only the Bordeaux District Court shall have jurisdiction. This clause applies without prejudice to the jurisdiction clauses contained in the buyer's documents. V6.-.June 2020
